Route 400 accident results in driving while intoxicated charge
East Aurora Police report the arrest of a Wales man for driving while intoxicated and a number of other charges after the man reportedly struck a guardrail with his van on Route 400 and abandoned the vehicle.
Officer Patrick Welch was dispatched to the southern-most part of Route 400 after police received the report from a witness at 1:24 a.m. Monday, Aug. 30. The witness said the vehicle was traveling at a high rate of speed when it struck the guardrail.
When Welch arrived at the scene, he said he located the offender, Shawn Behen, 22, walking south on Olean Road with blood dripping from a wound on his face.
Welch interviewed the offender and determined the smell of alcohol on his breath. After he called for medical assistance, Welch said Behen became uncooperative, trying to kick Officer Dustin Waldron, at the scene to assist Welch, in the groin and missing. Welch said Behen fell and struck his head on the lower portion of the patrol car.
Behen was then transported by ambulance to Erie County Medical Center, where he reportedly refused to allow the hospital staff to draw his blood to determine his blood alcohol content.
He was subsequently charged with DWI, resisting arrest, obstruction, leaving the scene of a property damage accident, failure to keep right on a two lane road, speed not reasonable and prudent and not wearing a seatbelt while driving.
He is due in Aurora Town Court at a later date. His vehicle was towed from the scene.
